Hayaa Terms of Service

Introduction
These Terms of Service ("Terms") govern your access to and use of Hayaa, a mobile application ("App") operated by Hayaa LLC, a Michigan limited liability company ("Hayaa", "we", "us", or "our").
By creating an account, installing the App, or otherwise using Hayaa, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the App.
These Terms form a binding legal agreement between you and Hayaa LLC. Please read them carefully.
Eligibility
You must be at least 18 years old to create an account and use Hayaa. The App addresses sensitive topics — compulsive pornography and masturbation, recovery, mental health, and Islamic religious practice — that we believe are not appropriate to offer to minors.
By using the App, you represent and warrant that you are 18 or older and have the legal capacity to enter into these Terms in your jurisdiction.
If we learn that an account belongs to someone under 18, we will close the account and delete the associated personal information.
Your Account
To use most features of the App, you must create an account. You may sign up with an email address and password or, where available, with Sign in with Apple or Sign in with Google.
You are responsible for safeguarding your account credentials and for any activity that occurs under your account. Notify us immediately at support@hayaa.io if you suspect unauthorised access.
You agree to provide accurate information during onboarding (including your age, sect, and other profile fields) and to keep it up to date. Providing materially false information may result in account termination.
You may have only one personal account. Creating duplicate accounts to evade bans, abuse referral programs, or work around any feature limit is prohibited.
Acceptable Use
You agree to use the App only for its intended purpose — your own personal recovery and reflection — and in accordance with our Community Guidelines.
You will not:
- Harass, threaten, intimidate, or discriminate against other users, partners, or moderators.
- Post or share graphic descriptions of pornography, masturbation, sexual abuse, or self-harm in any community area or partner conversation.
- Glorify, encourage, or solicit relapse in others.
- Proselytise, denigrate other Islamic sects, or attempt to convert other users to a particular madhab. Hayaa serves Muslims of all backgrounds.
- Send unsolicited messages, advertise products or services, or recruit users for any commercial purpose.
- Impersonate any person, falsely state your affiliation with anyone, or use someone else's display name.
- Upload viruses, malware, or any code designed to disrupt the App or the devices of other users.
- Attempt to reverse-engineer, decompile, scrape, automate, or otherwise interfere with the App or our servers, except as permitted by applicable law.
- Use the App in violation of any applicable law or regulation.
The App provides educational and supportive content. It is not a substitute for professional medical, psychological, or religious counsel. If you are in crisis or considering self-harm, please contact local emergency services or a qualified professional.
Your Content
You retain all rights in the content you create within the App — journal entries, AI conversation messages, community posts and replies, partner messages, and any other material you author ("Your Content").
By submitting Your Content to the App, you grant Hayaa LLC a worldwide, royalty-free, non-exclusive licence to host, store, reproduce, transmit, display, and adapt Your Content solely to operate and improve the App and to provide it to you and, where applicable, to other users you have authorised to see it (e.g. community posts visible to your sect feed, partner messages visible to your matched partner).
This licence terminates when you delete the content or your account, except to the extent that we must retain copies for the purposes described in the Privacy Policy (legal compliance, fraud prevention, dispute resolution).
You represent and warrant that you have all rights necessary to grant this licence and that Your Content does not infringe the rights of any third party.
We may remove or restrict access to Your Content at our discretion if we believe it violates these Terms, the Community Guidelines, or applicable law.
Community Guidelines
Use of the community features (posts, replies, reactions, partner connections) is subject to the Hayaa Community Guidelines, available in Settings → Community Guidelines and incorporated into these Terms by reference.
Violations of the Community Guidelines may result in content removal, temporary suspension of community access, or permanent account termination, depending on severity and recurrence.
Subscriptions, Billing & Free Trials
Some features of the App require a paid subscription ("Premium"). Premium subscriptions are sold through the Apple App Store and Google Play Store. Hayaa LLC does not process payments directly and does not receive or store your payment card or banking details.
All purchase, renewal, refund, and cancellation operations are governed by the terms of the store from which you purchased — see the Apple Media Services Terms and Conditions or the Google Play Terms of Service.
New users may be eligible for a free trial period. Trial length, eligibility, and behaviour are managed by RevenueCat and the underlying store. Unless cancelled before the end of the trial, your subscription automatically converts to a paid subscription at the price listed in the App when you started the trial.
Cancellation: you can cancel your subscription at any time through the subscription management screens of the Apple App Store or Google Play. We do not have the ability to cancel a subscription on your behalf. Cancellation takes effect at the end of the current billing period; you retain Premium access until then.
Refunds: refund requests are processed by Apple or Google according to their policies. We are not able to issue refunds for purchases made through the App Store or Play Store.
Price changes: we may adjust subscription pricing for new purchases at any time. Existing subscribers will be notified of changes affecting their next renewal as required by the relevant App Store.
Suspension & Termination
You may stop using the App at any time and delete your account in-app under Settings → Delete Account.
We may suspend or terminate your access to the App, with or without notice, if we reasonably believe that (a) you have violated these Terms or the Community Guidelines, (b) your conduct poses a risk of harm to other users or to Hayaa, (c) we are required to do so by law, or (d) we are discontinuing the App or a feature you rely on.
Termination does not entitle you to a refund for any unused portion of a Premium subscription, except where required by applicable consumer protection law or the operating store's policies.
Disclaimers
The App is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
Hayaa does not warrant that the App will be uninterrupted, error-free, secure, or free of viruses; that defects will be corrected; or that any specific feature will continue to be available.
Hayaa is not a medical, psychological, psychiatric, or religious authority. Content in the App — including AI-generated responses, Islamic content drawn from third-party sources, recovery suggestions, and milestone celebrations — is educational and supportive in nature. It is not a substitute for diagnosis, treatment, or scholarly religious guidance.
Verses, hadith, duʿās, and scholar references displayed in the App are drawn from public sources and may contain transmission errors or translation choices we do not endorse. Where you intend to rely on a citation for religious practice, consult a qualified scholar.
If you experience suicidal thoughts, self-harm urges, or any mental-health crisis, please contact local emergency services or a qualified professional immediately. The App is not designed to handle crisis situations.
Limitation of Liability
To the maximum extent permitted by applicable law, Hayaa LLC and its officers, directors, employees, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including loss of profits, loss of data, loss of goodwill, or substitute service costs — arising from or relating to your use of the App, even if we have been advised of the possibility of such damages.
In no event will Hayaa LLC's aggregate liability arising from or relating to the App or these Terms exceed the greater of (a) one hundred US dollars (USD $100) or (b) the total amount you paid to Hayaa for the App in the twelve (12) months preceding the event giving rise to the claim.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, the foregoing limitations apply to the maximum extent permitted by law.
Indemnification
You agree to defend, indemnify, and hold harmless Hayaa LLC and its officers, directors, employees, contractors, and affiliates from and against any claims, liabilities, damages, losses, and expenses — including reasonable legal fees — arising out of or in any way connected with (a) your access to or use of the App, (b) Your Content, (c) your violation of these Terms or the Community Guidelines, or (d) your violation of any rights of a third party.
Disputes & Governing Law
These Terms are governed by the laws of the State of Michigan, United States of America, without regard to its conflict-of-laws principles.
Before initiating any formal legal action, you agree to first contact us at support@hayaa.io and attempt to resolve the dispute informally. We will attempt to respond and discuss within thirty (30) days. Many disputes can be resolved this way.
If informal resolution fails, any unresolved dispute will be brought exclusively in the state or federal courts located in Wayne County, Michigan, and you consent to the personal jurisdiction and venue of those courts.
Class actions are not permitted. You agree to bring claims only on an individual basis and not as a plaintiff or class member in any class, consolidated, or representative action.
Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction to protect intellectual property rights or confidential information.
Changes to These Terms
We may revise these Terms from time to time. When we make material changes, we will notify you within the App and update the "Effective date" above. Where required by law, we will obtain your renewed acceptance before the changes take effect.
Continued use of the App after the effective date of revised Terms constitutes acceptance of the revised Terms. If you do not accept the revised Terms, your sole remedy is to stop using the App and delete your account.
Miscellaneous
These Terms, together with the Privacy Policy and Community Guidelines, constitute the entire agreement between you and Hayaa LLC regarding the App and supersede any prior agreements on the same subject.
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.
You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
